1. Acceptance of Terms
By creating an account or using LucidCases, you agree to these Terms of Service. If you do not agree, please do not use the platform. These terms apply to all users, including free-tier, paid, and institutional users.
2. Nature of the Service
LucidCases is an AI-powered medical education platform that provides simulated clinical scenarios for learning purposes. LucidCases is not a medical device, is not FDA-cleared, and does not provide medical advice, diagnosis, or treatment recommendations.
3. Accounts
You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. You must be at least 18 years old to use LucidCases. One person per account — sharing accounts is not permitted.
4. Acceptable Use
You agree not to:
- Use LucidCases for actual clinical decision-making with real patients.
- Share simulation content in ways that could be mistaken for real clinical guidelines.
- Attempt to extract, reverse-engineer, or replicate the AI system prompts.
- Abuse the API or attempt to circumvent rate limits or security measures.
- Use the platform for any illegal purpose.
- Share your account with others or create multiple accounts.
5. Subscriptions & Payments
LucidCases offers free and paid tiers. Paid subscriptions are billed monthly or annually as described at time of purchase. Payments are processed securely via Stripe.
- Free tier: Limited number of cases per month. No credit card required.
- Paid tiers: Billed automatically. You can cancel anytime from your account settings.
- Refunds: Refunds are available within 7 days of a new subscription or renewal if you have not used more than 5 cases in that billing period.
- Institutional plans: Governed by separate institutional agreements.
6. Intellectual Property
LucidCases's software, design, AI prompts, and educational content are the property of LucidCases and its licensors. You retain ownership of any text you input during simulations. By using LucidCases, you grant us a license to process your inputs for the purpose of delivering the service and improving educational quality (using anonymized, aggregated data).
7. AI-Generated Content
All simulation responses, feedback, and scores are generated by AI. While we strive for clinical accuracy, AI-generated content may contain errors, hallucinations, or outdated information. LucidCases makes no warranty that AI outputs are clinically accurate, complete, or suitable for any particular purpose beyond education.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUCIDCASES AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM. Our total liability for any claim shall not exceed the amount you paid to LucidCases in the 12 months preceding the claim.
LucidCases is not responsible for clinical decisions made based on platform content. Users are solely responsible for their own clinical judgment and practice.
9. Termination
We may suspend or terminate your account if you violate these terms. You may delete your account at any time. Upon termination, your data will be deleted per our Privacy Policy, except where retention is required by law.
10. Changes to Terms
We may update these terms from time to time. Material changes will be communicated via email or in-app notice at least 30 days in advance. Continued use after changes take effect constitutes acceptance.
11. Governing Law
These terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration under the rules of the American Arbitration Association.
